The CLE program "Subchapter V of The Small Business Reorganization Act of 2019: A New Opportunity for Successful, Cost-Effective Reorganization" was originally presented and recorded on July 31, 2020.
As of February 19, 2020, certain small business debtors may elect to proceed under the new Small Business Reorganization Act of 2019 (“SBRA”), which is found at new subchapter V of chapter 11 of the Bankruptcy Code. This panel presentation will review the most important provisions and benefits of the SBRA, the reasons why a small business debtor might choose to elect or not to elect to proceed under subchapter V, the role of the appointed subchapter V Trustee, and the stringent timing requirements under the SBRA. The panel will also review initial court decisions applying and interpreting the new law, as well as potential issues for litigation arising from perceived gaps in the legislation.
