Summary

The CLE Program "Back to School: When a Student Misbehaves" was originally presented and recorded on August 22, 2019.

Many of today’s schools have taken a zero-tolerance approach to discipline. When a student acts out, their actions could be construed as violent and disruptive, and bring with them police involvement and criminal charges. Our panel will explain the legal issues that arise in the intersection between school discipline, education law and criminal procedure. Children can get into all kinds of trouble – from playing with firearms to hacking into someone’s social media account. This presentation will shed light on school disciplinary hearings, while examining other legal issues that arise in arrests of school-age children and practical strategies for effective representation of such defendants. Criminal allegations or disciplinary issues related to guns, drugs, alcohol, theft, academic dishonesty, truancy and many more will be covered.
