Summary

The CLE Program "Developments in the Law of Sex Discrimination – More Questions Than Answers" was originally presented and recorded on March 27, 2019.

Title VII of the Civil Rights Act of 1964 prohibits discrimination “because of . . . sex.” The debate over just what this means continues, especially in light of claims that discrimination on the basis of sexual orientation and gender identity fall within the scope of Title VII’s prohibition on sex discrimination. As courts wrestle with these issues and the US Equal Employment Opportunity Commission and the US Department of Justice find themselves on opposite sides of the issue, the implication for employers and their employees remains unclear. Ed Trent will discuss the recent developments in this area of the law and some of the actual and potential consequences.
