Summary

The KBA CLE program "Calling ALL Lawyers: Respond to the New Restoration of Citizenship Rights" was originally presented and recorded on July 17, 2025.

Restoring a person’s citizenship rights after a felony conviction can be daunting. This session will offer a legislative update explaining the significant changes in the law that are now in effect. The session will examine each of the five citizenship rights lost when a person has a felony conviction. The session will offer a clear outline for preparing and filing petitions to restore a person’s citizenship rights in Circuit Court. It will cover common pitfalls in helping a client restore the right to vote and the right to possess a firearm. The session will ultimately provide participants with the necessary sample petitions and resources for restoring citizenship rights. The CLE will also discuss the importance of our ethical obligations to our clients, especially pro bono clients. It will connect Rule 1.1 (Competence) and Rule 1.3 (Diligence) to the process of seeking out complete criminal histories and expunging clients’ records. It will also cover Rule 6.1 (Pro Bono) and how it protects against potential conflicts.
