Summary

The KBA CLE program "Inquiries into Lawyer and Law Student Wellness: Mental Health. Substance Use" was originally presented and recorded on October 23, 2025.

The legal profession has devoted significant attention in recent years to improving the wellness of lawyers and law students. One area that has lately attracted attention within the profession is the extent to which law schools should ask applicants and students to disclose mental health and substance abuse issues as part of the law school application process and during law school. A related issue is the extent to which it is appropriate for state licensing authorities to inquire into such matters during the bar application process and to impose practice conditions on licensed lawyers and bar applicants with a history of such issues. This presentation will address the potential tension between the bar’s goals of ensuring competent practice, safeguarding the public interest, and promoting lawyer wellness when it comes to mental health and substance abuse issues.
