Summary

The KBA CLE program "Issues in Chapter 13 Bankruptcies for Debtor and Creditors Counsels" was originally presented and recorded on October 29, 2025.

This program will address several critical and timely issues in Chapter 13 practice. Learn how to avoid common mistakes in the means test, including frequently overlooked deductions that can significantly reduce the debtor’s bottom line. Explore the evolving treatment of tenancy by the entireties and how shifts in this area may affect which unsecured creditors get paid when TBE equity exists. The program will also include important case law updates every practitioner should know, along with practical guidance on serving plans for creditors listed in Sections 3.2 and 3.4—including where to obtain accurate service addresses. Finally, we’ll review the upcoming changes to FRBP 3002.1, effective December 1, 2025, and discuss how to properly use and respond to the Rule’s new provisions.
