Summary

The KBA CLE program "Legislative Update: A New Look for the Tennessee Expungement Statute" was originally presented and recorded on July 24, 2025.

The Tennessee Expungement Statute has been reorganized and simplified. And it went into effect on the day it was signed by the governor! This CLE will outline how the expungement statute has been restructured and provide a roadmap for the new sections. The session will specifically offer a deep dive into the complexity of expunging convictions. Through sample clients, we will practice analyzing criminal histories to determine if eligible convictions can be expunged. The session will also provide a step-by-step guide on how to prepare and file expungement petitions, as well as the processes required in different counties. The CLE will also discuss the importance of our ethical obligations to our client,s especially pro bono clients. It will connect Rule 1.1 (Competence) and Rule 1.3 (Diligence) to the process of seeking out complete criminal histories and expunging clients’ records. It will also cover Rule 6.1 (Pro Bono) and how it protects against potential conflicts.
