The CLE Program "Breaking Away From Bad: Avoiding Troublesome Clients and Ethically Handling Mistakes Made for the Good Ones" will be presented as a Webinar presentation on Thursday, November 10, 2022, from 12 - 1 p.m. (Eastern Standard Time). The program has been approved for one hour of dual "distance learning" CLE credit.
This presentation will address two different topics that might be more related than you think at first. Mistakes in the practice of law are both inevitable and avoidable, and when they occur they trigger a variety of ethical issues and obligations for the lawyers involved. When they happen in the course of representing clients for whom it was a mistake to agree to be their lawyer in the first place, they can be doubly unpleasant. So, in addition to addressing ethical obligations brought about by mistakes, this course will also discuss ways that lawyers can try to avoid taking on “unworthy” clients in the first place. Lawyers who attend this course will learn practical ways to evaluate the worthiness of clients on the front end, beyond just whether or not the client appears to be able to pay, and be reminded of ways they can refine and improve their intake process to remind themselves to ask all of the best questions before committing to an attorney-client relationship and all that means. Attendees will also learn about recent ABA ethics opinions addressing the duty to notify clients about errors as well as practical guidance about how to go about making a client aware of mistakes and reasons why it may be advantageous to do so even in the absence of a clear ethical duty under RPC 1.4.

Once installed, I encourage you to go ahead and click the meeting link above NOW and join the meeting to test it out, make sure everything is working properly, and get familiar with the interface. You can then leave the meeting and then re-join again at the appointed meeting time. Absent a computer or mobile device, you can just join with a telephone call (audio only), but the best meeting experience by far is to use a computer or iPad, so you can see others and what is being presented.
2. For computer/mobile device connection: If you don’t already have the Meetings app installed, you will be prompted to do a quick installation when you click the meeting link. Once installed, you don’t need to “sign in” or “create an account”, you just need to join the meeting. Only the host of a meeting has to have an account. Once you join with your computer, you will be asked if you want to use the computer audio or dial in by telephone for your audio. You can use computer audio if you have a headset or are on a mobile device or laptop with camera/mic – webcams are encouraged; otherwise, dial in via telephone for your audio, following the on-screen instructions.
3. If you encounter any technical difficulties at all during the meeting, and it is persistent, sometimes it is best just to leave the meeting and then rejoin it. If you encounter any difficulties or have questions as a result of the test above, just contact me well before the meeting so that we can resolve.
