The KBA Corporate Counsel Section is proud to present a ”In-House Counsel Toolbox Series: Lessons Learned: e-discovery trends for Corporate America” CLE program.

Lessons Learned: e-discovery trends for Corporate America

Join us for a panel discussion regarding practical solutions to the increasing problems (and costs) faced by companies dealing with the issue of electronic discovery. Our panel will use recent case decisions to guide the conversation as they discuss current and evolving demands relating to preservation and collection of electronic information, and the benefits to creating an effective information governance policy to save your company money in litigation. The panel will also discuss evolving trends in the review process that allow companies to refocus their litigation spend on the merits of the case, and hopefully avoid costly litigation that focuses on the discovery process.

• Nacco v. Lilly (WDTN). Sanctions imposed for failing to promptly preserve data;
• Adair v. EQT (WDVa). Cost-shifting; costs associated with in-house review vs. using outside vendor; clawback agreements;
• Da Silva Moore v. Publicis (SDNY). Judicial approval of predictive coding; criticism of keyword or Boolean search; follow up with Kleen Products
• Victor Stanley. Privilege and key term search methodology issues. Beginning of "Angels Fear to Tread Cases"
• Apple Inc v. Samsung Electronics. $400 million dollar sanction for failure to preserve

The program will be presented during the Corporate Counsel Section Meeting. Please try to arrive at 5:00 p.m. so that section members have an opportunity to visit before the CLE begins at 5:30 p.m.

The program has been approved for 1 hour of Dual CLE credit.

KBA Members - $ 20
Non-KBA Members - $ 30
KBA Law Student Members - $ 0
Staff of KBA Members - $ 20

You do not need to be a member of the section in order to attend the CLE program. KBA Members not wishing to receive CLE credit may attend the program at no charge (handout materials not included).

A reservation is required in advance of the program. There is a $ 5 additional charge for registration on the day of the program.

Cancellation/Refund Policy: Reservations cancelled less than 48 hours before the program are subject to the penalty of the entire amount. Substitutions may be made.
