Event Description: The KBA ADR Section presents a seminar entitled ”Joint Session Mediation: Getting the most out of this mediation tool!”.The CLE program features Joseph G. Jarret, Knox County Law Director. The program has been approved for one hour of general CLE credit and one hour of general CME credit. The experienced mediator cannot deny the utility of caucus or separate session mediation, especially when there exists abject hostility between the parties. However, one of the pitfalls of caucus or private session mediation is the ability of the parties to make outrageous demands or deliver unrealistic proposals from the cocoon of their private space. They are able to do so without explanation or justification, throwing the responsibility for the outcome of the negotiation onto the mediator. Further, the parties spend much of their energy in persuading the mediator, instead of each other, of how the case may be settled. Enter the mediation tool of joint sessions. By engaging the parties in joint session, the mediator prevents the parties from becoming detached from each other by encouraging them to engage in constructive confrontation. This program will discuss the utility of joint session mediation as means to achieve successful mediation outcomes. You do not need to be a member of the section in order to attend the CLE program. KBA Members not wishing to receive CLE credit may attend the program at no charge (handout materials not included).
