The program will be moderated byveteran mediator Pam Reeves who will raise questions and present insights about the ethical, strategic and negotiation issues presented by the actors. The topics will include pre-mediation planning, ways to address impasse, issues presented in writing up the greements as well as discussion about how to best achieve a successful result in these emotionally charged situations.=0D=0AThis CLE will feature a re-enactment of a mediation of a tort case arising from the death of an 18 year-old. Mediation will include the initial joint session of the parties and how the mediator attempts to have each party discuss their case. The mediator will ask appropriate questions during the initial session and discuss his techniques at this stage. There will also be an initial private session with each party wherein the mediator will elicit and discuss sensitive facts and develop options for settlement. The mediator will utilize a number of techniques to attempt to bring settlement, including using hypothetical questions, how to answer discussions of legal success or failure, use of subtle persuasion and discussions of potential summary judgment.
